Terms of use

These terms are the agreement between you and Alex Strasman Design Ltd, the provider of fortyfive. We’re registered in England and Wales under company number 09346337, with our registered office at 19 Zeals Rise, Zeals, Warminster, England, BA12 6PJ. You can contact us at feedback@playfortyfive.com. Please read these terms before using the app.

fortyfive is in testing. These terms cover the test versions on TestFlight and Google Play.

What fortyfive does

fortyfive helps you record tennis scores, hear score announcements, review matches, connect with other players, and share results. Matches are stored on your device and synced to your account, and finished matches are shared with the players linked to them.

The app is a scoring aid. Check the match format and the recorded score with the other players. Announcements and results depend on the points entered, and a result in the app isn’t an official tournament record or an umpire’s decision.

Who can use it

fortyfive is for people aged 16 and over. If you’re under 18, check that you’re allowed to agree to these terms in your country, and ask a parent or guardian if you’re not sure.

You must also be allowed to use the app under the rules of the service you got it through: Apple’s TestFlight or Google Play. Those rules apply alongside these terms.

Your account

You need a fortyfive account to use the app. Use an email address that’s yours to use, keep sign-in codes private, and tell us if you think someone else has got into your account. Your display name can be a nickname. Don’t use it to pretend to be someone else.

You need a connection to sign in and to use the online features. After that, scoring carries on offline and changes wait to sync. Matches already on a device upload when you first sign in. Use your own account on your devices, and take care on a shared device, because signing out leaves its matches in place.

Permission to use the app

You may install and use fortyfive on devices you own or are allowed to use, under these terms and the rules of Apple or Google, whichever you got it from. The app’s software, name, and design belong to us or to the people who license them to us.

You can save and share the score images the app makes. You keep any rights you have in the names, match information, and other content you enter. Entering it doesn’t make it ours.

You give us permission to store, copy, and display that content only as far as we need to run the features you use: syncing your matches, showing your profile to friends, and sharing results with the other players. That permission doesn’t cover advertising. Personal information is also covered by the Privacy policy and by data protection law.

Open-source components have their own licences, listed in the app’s About screen. These terms don’t limit any rights those licences give you.

Using fortyfive responsibly

Use the app lawfully and respect other people’s privacy and rights. Don’t use it to impersonate someone, share information that isn’t yours to share, spread harmful software, or interfere with how the app works.

Put your phone somewhere safe and stay aware of the court and the people around you. Keep the speaker volume right for where you are.

Your matches and shared results

You choose the names and scores you enter. Tell other players when you record and upload their information. Only link accounts that belong in the match. A finished match is shared automatically with the players linked to it. Sharing an image outside fortyfive is a separate step that you choose.

Players in a shared match can confirm or dispute the result. A result that nobody disputes is treated as confirmed 7 days after it was shared, and counts in head-to-head statistics. Confirmation is the app’s record. It doesn’t make a result official.

Deleting a shared match removes it from your history and from the statistics you share, but the other players may keep their record. Unfriending or blocking someone doesn’t erase matches already shared with them. The Privacy policy explains deletion and your rights.

Syncing needs a working connection. A match that’s still waiting to upload can be lost if the phone is lost or the app is removed. A score image isn’t a backup and can’t restore a match’s points. These limits don’t reduce our responsibility where a loss is our fault.

Privacy

Our Privacy policy explains accounts, what’s stored on your phone and online, profiles, shared matches, notifications, emails you send us, and what TestFlight and Google Play share with us. It also explains how to contact us about your information.

Testing

This version is still being built and may contain mistakes. Features can change between builds, and test builds can expire. fortyfive is free while it’s in testing. Taking part doesn’t oblige you to send feedback or to pay for a later version.

Deleting your account

You can delete your account in the app, under You › Profile. The Privacy policy describes what’s deleted, what stays on your phone, and what happens to matches other players still have.

Updates and stopping

We may update fortyfive to fix problems, keep it working with new versions of iOS and Android, meet legal requirements, or improve it. We’ll explain important changes to these terms and give reasonable notice where we can. Urgent security or legal changes may need to happen sooner. Changes won’t take away rights you already have.

You can stop using fortyfive at any time. We may end testing when it’s finished, or stop someone taking part after a serious breach of these terms, such as deliberately interfering with the app. Where we can, we’ll explain why and give reasonable notice so you can save important results.

If something goes wrong

We’ll use reasonable care and skill in providing fortyfive. Contact feedback@playfortyfive.com if something isn’t working as described, so we can look into it.

We’re responsible for loss or damage that’s a foreseeable result of our breaking these terms or failing to use reasonable care and skill. A loss is foreseeable if it’s an obvious consequence, or if you and we knew it could happen when you started using the app.

Nothing in these terms excludes or limits our responsibility for fraud, for death or personal injury caused by negligence, or for anything else the law doesn’t let us exclude or limit. Your statutory consumer rights stay in place.

Resolving a disagreement

Please contact feedback@playfortyfive.com first so we can try to put things right. Doing so doesn’t stop you using legal remedies or contacting a regulator.

These terms are governed by the law of England and Wales. If you’re a consumer, that doesn’t remove protections given by the law of the country where you live, and you can bring a claim in the courts available to you under consumer law.

If part of these terms can’t be enforced, the rest still applies wherever it fairly can.
